The proofs all over the place on hardware sites mainly, they done something to a clipping plane so the card didn;t have to render as much in 3d mark so it would obviously have a performance advantage.

The funny thing is, in an article I saw on slashdot today, the 9800 pro still beat it even with the tricked out drivers.

It might be "old" but this is really the first official comfirmation anyones given that yes indeed nvidia are cheating.

Accused never proved. This is the first ive ever heard of a company issueing a patch to stop a gfx card company from cheating in a benchmark.
