like stackem said, most times it is legal to hunt on private property without a license. Also, like stackem said, you can't assume facts unless you know they are true. Hunting accidents happen, it's a dangerous activity, no matter how experienced someone is at hunting or with firearms, there is always a chance for something to go wrong, hence the term "accident."

In a situation like this the shooter would most likley be on the hook for at least negligence..

I know for a fact Dick Cheney was high on meth and confused the elderly gentlemen for a terrorist, he, at the time, though he was doing a noble deed for his nation. It's understandable, we've all shot a man in the face atleast once.

The thing is, we don't know if he was failing to exercise the appropriate degree of care. That could easily be argued.

It was an accident. Nobody's arguing that, but he shot someone. There are consequences to accidents. Cheney did not exercise an appropriate degree of care because if he did, the person would not be in the hospital right now.

i dunno, those orange vests are hard to spot. you need to be careful when shooting, it doesnt matter if he 'walked into it.' if you are shooting, you should take care to know where everyone is and keep your eyes open in case someone is in your line of fire or anywhere NEAR that line of fire. i wouldnt be shooting unless everyone in my party was directly to my rear, left or right and that there was no chance someone was moving in my direction.
