i get a newsletter everymonth from my ISP that warns about viruses, and has hints and what not and sometimes it mentions specific programs or files, y?

the only way they can obtain proof that you're downloading anything is through illegal means. this allows you to counter-sue or cause a mis-trial thus scaring them away from any legal action that they could take.

I work for an ISP and this has happened all over the place. All they do is take the domain name from your email address and then fake an email about this.

If your ISP is anything like us they have an abuse dept and they would more likely contact you thru phone than email as it isnt secure.

and Merlin your wrong bud all the ISP would need to do is monitor traffic thru certain ports (which they have a legal right to do)
and suggest to the court they feel it "may" have been used by P2P software to download protected stuff. But if that was to happen and it went as far a court your pc would have been seized and checked for that type of stuff by then anyway.
