According to the father and Montgomery police spokesman Lt. Huey Thornton, the robbery began when a man with a .38-caliber pistol approached to take Sgt. Lowery's customized Chevrolet Suburban. Lowery got out and gave up the keys but the gunman shot the Marine. Lowery then got his .45-caliber pistol from the car and shot multiple times, Thornton said. Dead at the scene was Thaddeus Antone, 19, of Montgomery. The bullet hit Lowery in the top left cheek, close to his nose, and stopped near his voice box, the father said. Lowery was listed in fair condition at Baptist Medical Center South, Mandy Harrison, public relations coordinator for Baptist Health in Montgomery, said Wednesday. Lowery's leave was to end this Sunday and he was scheduled for duty on Christmas Day, his father said. The year began with Sgt. Lowery marrying April Leigh Fitzgerald of Hueytown in mid-January. A week later, he went to Afghanistan for about two months, his father said. The Marine Corps had no official comment Wednesday. Lowery serves with Marine Aerial Refueler Transport Squadron 252, based at the Marine Corps Air Station, Cherry Point, N.C., the father said. The unit flies KC-130 tankers that can refuel helicopters or Harrier jets in midair. The fatal shooting of Antone near a gate of Maxwell Air Force Base is viewed as a case of self-defense and no charges were filed, Thornton said. Following normal procedure, a Montgomery County grand jury will review the case. Thornton said he doesn't expect the grand jury to change the self-defense finding.
