12-Year-Old Grounded for Too Much Internet Use Gets Punishment Overturned in Court

A Canadian court has overturned a father's punishment for his daughter after she refused to stay off the Internet, his attorney said Wednesday.
The girl, 12, took her father to Quebec Superior Court after he refused to allow her to go on a school trip for chatting on Web sites and then posting "inappropriate" pictures of herself online using a friend's computer, AFP reported.
The punishment was for the girl's "own protection," according to the father's attorney, Kim Beaudoin, who is appealing the ruling.
"She's a child," Beaudoin told AFP. "At her age, children test their limits and it's up to their parent to set boundaries. I started an appeal of the decision today to reestablish parental
authority, and to ensure that this case doesn't set a precedent."
Otherwise, she continued, "Parents are going to be walking on egg shells from now on."
According to court documents, the girl's Internet usage was the latest in a rash of disciplinary problems. But Justice Suzanne Tessier, who was presiding over the case, found the punishment too severe.

What the fuck? How'd this even get in court? This is bullshit.

totally gay and now the girl will grow up to be a pole dancin prostitute because she won't take discipline from her father ever again.

And you can pretty much take anyone to court for anything, it's just the judge is a douche. Should have thrown the case out and said the father is responsible for punishment, not the court. Although I guess the court is deciding if the punishment is warranted or not. But I don't think that's the courts decision to make. That's the fathers.

Just the scary thing about this is if it will set the precedence for things like this.

Not to be an arrogant and ignorant American, but does Quebec have the same exact court system and stuff as the rest of the country? I know the Frenchies are weird and all, but how much does that 'culture' differ from the rest of the main country?

ninty 06-20-2008 09:32 AM

I don't think it's different. It's basically up to the judge. Provincial cases don't have a jury I don't think, because their lower down. If you get tot he supreme court of canada, there will be a jury. Maybe each provincial court is a little different since they work for the province, not the country as a whole. But I generally just think it's up to the judge who is hearing the case really. Don't think it's all that different from the American system, just some terminology is different.
