Spawning "on" or near someone also depends on the map... Algiers and Crossroads come to mind. You sometimes spawn right next to the enemy and its who shoot's first gets the kill most of the time...

Algiers/Crossroads have the worst spawining points of all the maps, the creator didn't put much thought into it for TDM, more for DM...

worst spawning = southern france on objective mode aka no respawns. 9 out of 10 times i will spawn right next to 2 or 3 enemies and if im lucky i will have enough time to kill at least 1 of them

ummm when I was telefragged it was because a guy spawned right on top of me. When I spawned I automatically died and the camera was facing up and there was a guy standing on me. This could just be a coincidence but I'm not sure.

The telefrag does not appear to be a cheat. It appears to be more of a bug with spawning points (usually when game lag is experienced). I have experienced it on my server with random telefrags. It only seems to occur after the server has been running for more than 4 or 5 hours.
