You gotta be kidding me ! You're gonna try to beat a ticket because the cop wasn't wearing his cap? Thats the most idiotic thing i've ever heard and just try to bring up that defense and see what happens. You'll get burned for sure. Do this instead....
Plead "Not Guilty" and go to court. It doesn't cost you a thing except time. If the cop doesn't show, they'll set another court date, and if he misses the 2nd date, most likely it'll get tossed out. If the cop shows up to court, you're gonna have to state your claim of innocence. You can make a claim that your speedometer was off due to new tires or something. You'll need a receipt from a repair shop so if you have a buddy in a shop, he can make a reciept for you. If not, then you may have to change the speedo gear in your transmission and then take it into a shop so they can find "a problem" and repair it or simply disconnect your speedo cable and bring it in for repairs. Either way, you're gonna have to show proof that there was a problem and that you fixed it.
Thats one idea....the other idea would be to explain that you were in moderate traffic next to a truck or something bigger than your car. You need to convince the judge that perhaps the truck interferred with the radar reading and that perhaps it was the other vehicle and not you that was going fast.
The bottom line is you need to make your case shed some doubt on the cops case. It's an uphill battle since the cop plays this game all the time and he's a pro at it but i've seen it work sometimes. And if you end up losing the case after putting up real good evidence (without undermining the cop), the judge will probably knock the offense lower like 10mph over the speed limit or something like that.
This is probably the most important advice i can give you.....don't try to make it sound like it was the cops fault (like that stupid "cap" trick). You go after his credibility and i guarantee you'll lose. Try to sound responsible and mature and you'll do good.......after all, you have nothing to lose!
Now, take this as a lesson and obey the traffic laws. If you want to drive fast, make sure you don't go over the poster speed limit by 10mph (and thats for hwy) and only 5mph for side roads.
Oh yeah, another good idea i forgot to mention....now is the time to take a safety course. It'll lower your insurance and it'll show the judge that you've taken steps to better yourself as a driver. Do this BEFORE you go to court.
