Of course not. You can only arrest someone when there is evidence that they've broken the law. International law works the same way -- you can't attack someone who has not attacked you first.
Is it a crime for Saddam to have weapons of mass destruction? Of course it is. But it's not America's job to rid him of them -- it's the UN's. This whole affair is out of our jurisdiction.
