I don't think it's different. It's basically up to the judge. Provincial cases don't have a jury I don't think, because their lower down. If you get tot he supreme court of canada, there will be a jury. Maybe each provincial court is a little different since they work for the province, not the country as a whole. But I generally just think it's up to the judge who is hearing the case really. Don't think it's all that different from the American system, just some terminology is different.
