The reason why the conferdate flag was banned from the school is for one reason and one reason only, it was disrupting the educational experience for the other students. If they took this case all the way to the Supreme Court saying that their first amendment rights were broken, they would get shot down by the supreme court. I know this because I am in a Legal Civics class this year and we've done debates on things dealing with the first amendment.

There was a case called the Tinker case that took place in school. Students were wearing black armbands with the peace symbol on it which was protesting the vietnam war back when it was going on. The school board tried to ban them from wearing armbands so they suspended them from school. The Tinkers took this to court and it was backed by the ACLU which is an organization that supports cases with first amendment offenses. The case went all the way up to the supreme court and they ruled in favor of the students. They said that the armbands was a freedom of speach via symbolic expression. But they could not ban them from wearing arm bands because it did not disrupt any other students educational experience.

You can say the same thing here only the confederate flag WILL cause issues in school because the KKK uses this flag during their rituals and such. I'm sure there's other reasons why the confederate flag will cause debates and things but that's probably the main reason.

You could try bringing this to court but...you wont win overall.
