Court Says Net Music Subpoenas Not Authorized

WASHINGTON (Reuters) - In a surprise setback for the recording industry, a U.S. appeals court said on Friday its methods for tracking down those who copy its music over the Internet are not authorized by law.

The Recording Industry Association of America, a trade group, has sought to force Verizon Communications and other Internet service providers to reveal the names of customers it suspects may be copying music without permission.

The recording industry says the widespread copying of music over the Internet is partially to blame for falling CD sales.

Verizon has argued that existing copyright law does not give the recording industry such authority and its customers' privacy was being violated.

A lower court earlier this year upheld the recording industry's tactics, which have served as the basis for hundreds of lawsuits filed against individual Internet users.

But in a strongly worded ruling, the appeals court sided with Verizon, saying a 1998 copyright law does not give copyright holders the ability to subpoena customer names from Internet providers without filing a formal lawsuit.

"In sum, we agree with Verizon that (the law) does not by its terms authorize the subpoenas issued here," Chief Judge Douglas Ginsburg wrote.

Neither Verizon nor the RIAA was immediately available for comment.

Welp, i had thought of switching my ISP, currently verizon. Guess i'll stick with em since they acctually seem to have fought for the privacy of there users. kudos to them.

A 12 year old kid... Yeah because she knows what copywrite laws are. The well her mom should have known arfument doesnt even work because parents are stupid as to what there kids are doing online. Not to mention she acctually PAID for kazza, and parents are typically ignorant as to computers in general. I mean honestly who here paid for kazza, obviously you know your doing something wrong.

Someone get me a picture of the swat guy aiming at that fucking cuban kid we shipped home. replace the kid with a girl, and teh FBI badges with RIAA and you have comedy gold.

the dumb thing is that she is not even at the to be held accountable of a crime but the RIAA can sue here for $2000

you guys wanna hear some great news!! overhere in the netherlands, there was a case at court if kazaa should be seen illegal or not.
The out come was: KAZAA isn't an illegal program, so everyone overhere can download music or movie's or what ever they want without being afraid of getting caught.
The Netherlands is the first country of the world that has said that kazaa is legal to use.
Now what do you think of that?!
