The man threw a tire at the officer, fracturing the officer's arm, Syblis said. The man then came at the officer, swinging a piece of metal.

That's when the officer opened fire, shooting the suspect three times, Syblis said.

The suspect, 22-year-old Santos Cabrera, is Hispanic. Some witnesses report the axe wielding man was Asian.

Cabrera had been released from the Fulton County Jail June 2nd, held for criminal trespass and theft by receiving, charges resulting from an incident at the same apartment complex where the boy's murder occurred.

Some speculate Cabrera ran from police because he did not want to go back to jail.
