There were abortions and birth control going as far back as ancient greece, egypt and rome. Though they werent as widely used as they are today, they were legal because no one had decided to pass laws against them.

Also, if you want to take this into account, early humans would smother or abandon babys born in the winter in order to make sure the tribe would survive. edit: the last source talks about abortions, but it refers to prostitutes having abortions. Prostitutes were damned since they had sex out of marriage.
