A conspiracy requires at least two people to conspire together to commit another crime.
Yup, and generally you're convicted based on evidence from a fellow conspirator as opposed to someone who is not involved and has little or no evidence regarding any type of preplanned murder.

You just assumed i was going to drive. Can you read my mind? Perhaps i just got home, im just sitting in my car cause im to drunk to stagger in. You didnt catch me on the road, nothing says you should be able to bust me sitting in my driveway. Burdon of proof would be a bitch on this one.

"well we stopped the subject while he was drinking in his car in his driveway... he was going to go somewhere i could feel it" "i could see the keys in his pocket with my X-ray vision."

Maybe im installing a new stereo and its being a bitch so im having a beer to calm myself down before ripping hte deck out of the car the hard way. Far to many variables to play this one.
one beer does not equal drunk.
oOo:

You're missing the point, Pyro.....If he had just polished off 12 beers and decided he was gonna go out to his car and fix his radio, you think it would be any different?
I think it's absurd that you can get a DUI just for sitting in a car.

I mean, sure I'd understand some cops coming to check on a dude, and even taking the keys off of him if it looked suspiscious, but actually charging someone on a DUI for that is nuts.[/quote:49a24]

Public intoxication is a crime as well...and im not really refering to a car in a driveway...cuz i think that is allowed.

there are too many jump to conlusions in this story. i dont see how the school has the authority to punish you for crimes outside of class. just because he traded the gun, it doesnt mean he was going to take it to school and shoot it up. he put it in the backpack because hes a kid and kids put stuff in their backpack. yeah he should be punished but not by the school. whats he going to do now? go to another one? police and parents got involved in this, thats as far as it should go.

here is something to think about ......My school restricts the use of drugs/alcohol in school area. which means no smoking/drinking in the parking lot, football/baseball fields etc...but if i cross the street and i start smoking. Out of nowhere my principal appears and we both make eye contact, would i get trouble?

oh yea i forgot im over 18...

he could call the cops or your parents and judging from whats going on in the other cases, yes he could bust you for it. i dont smoke or drink anyways, and why do it at school. plus you can get busted for drinking in public, whether you are drunk or not. thats why when you buy liquor, they put it in a brown bag for you.

why would you get introuble if you're over 18?

Kids ALWAYS smoke across the street from my highschool. Another weird thing is there is a supermarket across the street. Since juniors are given parking spots, alot of them park over in the parking lot of the supermarket. The supermarket will randomly call a towing company and get a bunch of the vehicles towed away. The funny thing is, there is a cop that does cross walk duty connecting the supermarket's parking lot and our highschool.
