I wouldn't think kicking someone "just because" they have a 56k is neccessary.
BUT, when I used a 56k(way back in '97), I only played on servers where I pinged 250 or less. And I pinged that low or sometimes even in the high 100's (180 or so). I had a kickazz connection for a modem, always connected at 42000, sometimes 44000.
Its just common sense modemers, why the hell would anyone want to play somewhere where they had a 300 ping or higher? If you absolutely get no servers under 300 ping, then you need to call the phone company, check your line for noise, tweak or whatever you need to do cause your connection it shite.
Would I kick someone with over a 300 ping? Yup. Better yet, the idea with just capping it at 300 or below sounds like the best way to go. I will definately implement that when I get my part-time ded server running again.
